Workplace Rights Your HR Department May Not Tell You About

by Alan Henry

Did you know that your employer technically can?t stop you from discussing your salary with others? Or that it?s not up to them whether you get overtime for working those extra hours or not? It turns out there are labor laws on the national level in the US and many at state and local levels that afford workers rights that you won?t find documented in most employee handbooks.

For example, most companies don?t care for employers discussing their salaries with one another?some have policies that say discussing your salary with others is grounds for termination, but the National Labor Relations Act says that employers cannot prevent staff discussing wages amongst themselves. Similarly, whether you get overtime for extra hours at work depends entirely on whether your position is exempt (salaried, so you get nothing) or non-exempt (hourly, you must be paid for every hour worked), not some magic formula concocted by your manager.

Of course, whether you?re willing to hold your employer?s feet to the fire and demand you be paid for overtime or that they obey the law is another story?jobs are hard enough to come by that you may not want to rock the boat, but you should be aware of your rights so you know when you?re being manipulated and when your company really appreciates your work. Hit the link below to read up on some more rights you may not even know you have.

Angels ship Ervin Santana to Royals in trade

ANAHEIM, Calif. (AP) ? The Los Angeles Angels traded right-hander Ervin Santana to the Kansas City Royals on Wednesday for minor league left-hander Brandon Sisk.

The Angels exercised Santana's $13 million option for next season before trading the Dominican veteran and cash to the Royals.

"We're proud to have him, and he certainly fits with what we're doing in 2013," Royals general manager Dayton Moore said.

Santana has been a fixture in Los Angeles' rotation since 2005, going 96-80 with a 4.33 ERA while starting at least 23 games in eight consecutive seasons. He has spent his entire career with the Angels, who signed him as a free agent in 2000 and nurtured his development into a solid starter of 96 games over the past three years.

But Santana struggled for much of last season, going 9-13 with a 5.16 ERA while giving up a major league-worst 39 homers despite significant improvements over the final two months. Santana's woes and Dan Haren's similarly slow start were major factors in the Angels' midseason struggles, forcing Los Angeles to make a trade for Zack Greinke and ultimately keeping them out of the playoffs for the third straight season.

With rising starter Garrett Richards already slated for the Angels' rotation in 2013, Santana has long realized he might be headed out of Orange County after the season.

"I have to realize that this is a business," Santana said, citing Kauffman Stadium as one of his favorites in the majors. "They trade me, and I just have to accept it and move on. It's going to be hard because I've known my teammates for a long time, but now I'm going to have new teammates. I can't wait to meet them in person and hang out."

The Royals made a similar deal last November for Jonathan Sanchez, giving up Melky Cabrera for the San Francisco starter who was expected to anchor their rotation. But Sanchez was a disastrous flameout, going 1-6 with a 7.76 ERA in just 12 starts before getting designated for assignment and eventually traded to Colorado.

Moore wasn't shy about dealing for Santana with just a year left on his contract, saying he hadn't discussed a long-term extension with the right-hander.

"We were able to scout Ervin during the entire year, specifically the second half," Moore said. "His August and September were really good. From a statistical standpoint, he was very good."

Moore said the Royals are paying "the majority" of Santana's $13 million deal.

Santana, who will turn 30 in December, has shown moments of brilliance in his career, which includes three seasons with at least 16 victories and an All-Star selection in 2008. He threw a no-hitter in 2011 and a one-hitter last season, yet confounded the Angels with his inconsistencies early in 2012.

"I don't have any physical problems," Santana said. "Everything was good. I just have bad luck. I was pitching good, and I didn't have the opportunity to win a lot of games."

The Angels are more interested in developing Richards and attempting to re-sign Greinke, who pitched well during his brief stint with Los Angeles. Ace Jered Weaver will top the rotation after his first 20-win season.

The Angels haven't announced whether they'll pick up Haren's $15.5 million option for next season before Friday's deadline. The club is thought to be shopping Haren, who had a career-worst 4.33 ERA while going on the disabled list for the first time.

Sisk spent last season with Triple-A Omaha, going 3-2 with a 2.54 ERA and eight saves. He's pitching in the Venezuelan winter league and has never pitched in the majors.

The Pat Files: Priorities

As usual, I'm going to blog about some annoying thing I've seen on my Facebook newsfeed, make elaborate comments on it like I always do and give my twopence worth about what I feel about it like anyone gives a damn. Oh well, I just like to get things off my chest and this is the only safe and legal way for me to do so regardless of whether anyone actually reads my blog or not.

So, I've been seeing these happy couples celebrating their anniversaries with their partners by declaring them on Facebook and all their friends wishing them long and prosperous lives together. Not that I have a problem with that, except for the fact that these so-called anniversaries are actually month-aversaries where they make a huge deal of being together after three months. Three bloody months. Like that's some huge accomplishment. What?!

Someone once told me, why count? There's no point to it. Come to think about it, we never celebrate any of our other relationships. We don't hug our friends and go "this day ten years ago, we became friends" and neither do we celebrate the anniversaries of relationships far more important to us like our parents. I'm not talking about Mother's or Father's Day where the whole world celebrates them in unison but I'm talking about the actual day you built your personal relationship with them. No-brainer alert that that day would be your birthday but you celebrate your birthday as the day you came into this world and not the day you became your parent's son or daughter.

So, think about it. We don't keep tabs on these relationships because you know they are going to last and will be there to follow you through every walk of your life. You know they aren't going anywhere so there is no need to count. The moment you put a timeframe on something, it's as if you are anticipating the fate that it has an expiration date and you are under pressure to see how long you can withhold it before it burns out.? If love is really supposed to be as fun and easy as they say, why put it under such pressure like this? Why tie it down to a ticking timebomb that goes under the guise of anniversaries?

And no, I don't believe in celebrating anniversaries because every day you are with the person you love should be cherished, not just on the day you met them. They shouldn't be celebrated because they shouldn't be regarded as accomplishments for being loyal to someone for any given period of time. It's nothing to be proud of. If it is indeed like any other relationship, it should be natural and effortless and just there.

Who knew I secretly had a hopeless romantic in me, aye? But no, seriously. This is about as practical as I can get when it comes to relationships.

I thank a very special friend for imparting this wisdom onto me :)

Monster Munch {Budget Gourmet Mom} - Around My Family Table

I hope you?ve enjoyed this month of popcorn treats. ?Some were sweet, some were savory, some were spicy, and we even had a fun centerpiece idea. ?Don?t forget today is the last day to enter the popcorn giveaway too! ?But before you run off and try to win your own popcorn package, check out Krista, from Budget Gourmet Mom, and Halloween Treat! ? I met Krista at Camp Blogaway earlier this year. ?I didn?t get to spend to much time getting to know her then, but have since become a HUGE fan of her site. ?She has tons of fabulous ideas and recipes and beautiful photography too! ?Here?s Krista?

I don?t know about you but I am notorious for letting things slide until the last minute, like holidays for example.

Today happens to be Halloween and it?s likely I?m going to need a heck of a lot of Diet Coke to even function today since I was up until the wee hours of the morning scrambling to get the kids costumes figured out.

This happens every year despite the fact that right after Halloween is over I vow to be on top of things next year and start getting their costumes ready in early September.? Yeah.? Don?t hold your breath.

Costumes may not be my specialty but making treats in a pinch is.? That?s exactly why I absolutely love my mom and popcorn.? For me those two things go hand in hand for two reasons.? My mom makes the BEST stove top popcorn ever and she always has awesome ideas for treats since she was a kindergarten teacher.? If I could talk her into publishing a blog she would have like a million followers in the first month.

Since she has yet to embrace the fame I?ll just benefit from all her cute ideas.? Like this Monster Munch, for instance.? Whether you are throwing a party today or stuck on candy duty these fun treat bags are fun for kids of all ages!

You?ll need goody bags or plastic bags for each child to make their own.

You?ll also need popcorn, gummy worms, Chex Mix, chocolate eyeballs, mini marshmallows, and pretzel sticks.? Whether you pop your own popcorn or use microwave popcorn it?s your choice.? Let the kids add a scoop of each to the bag and print labels for each one if you like!

Popcorn ? Monkey Brains

Gummy Worms ? Creepy Crawlies

Chex Mix ? Nuts and Bolts

Chocolate Eyeballs ? Eyeballs

Mini Marshmallows ? Ghost Poop

Pretzel Sticks ? Spiders Legs

?

?

Born and raised in Southern California, Krista Dearden started blogging in 2009 to stay in touch with her family.? Shortly after giving birth to her fourth son she created her blog, Budget Gourmet Mom.? In it she shares stories of motherhood, budget friendly recipes, and the occasional tip.? Connect with Krista on Facebook and on Twitter.

Truck drivers hard to find even in bad economy

Mark Duncan / AP

The U.S. is speeding toward a critical shortage of truck drivers in the next few years, but many trucking companies say they are having a hard time finding workers.

By Russ Bynum, Associated Press

SAVANNAH, Ga.???Tribe Transportation is a growing company that just added 10 new trucks to its tractor-trailer fleet. The problem has been hiring people to drive them.?

So far the Georgia-based company has filled four of the jobs, leaving six vacancies. The new hires are mostly veteran truckers in their 50s, men who probably won't spend too many more years behind the wheel, said Matt Handte, Tribe's executive vice president for sales and operations.

"It blows my mind that I'm looking for that many people and I can't find them," said Handte, who's also struggling to hire logistics brokers who line up freight transportation for customers such as PepsiCo, H.J. Heinze Co. and General Mills. "They aren't lined up at the door."

Even amid a struggling economy with high unemployment, trucking companies had a tough time hiring young drivers willing to hit the road for long hauls. Now the U.S. is speeding toward a critical shortage of truck drivers in the next few years as the economy recovers and demand for goods increases, an expert in the inner-workings of supply chains said in a report Tuesday.

U.S. companies are expected to create more than 115,000 truck driver jobs per year through 2016, but the number of Americans getting trained to fill those jobs each year is barely 10 percent of the total demand, said Page Siplon, executive director of the Georgia Center of Innovation for Logistics.

"Trucking accounts for how we move 80 percent of cargo in our nation" said Siplon, whose center is part of the Georgia Department of Economic Development. "If we don't have enough workers, it's going to be slower and more costly to move products. If I can't move as much product to the shelves as I want to, the cost to consumers goes up."

Siplon looked at a range of supply-chain jobs ? from truck drivers and warehouse workers to air cargo supervisors ? using career-specific employment forecasts by the U.S. Department of Labor and then comparing those numbers with Education Department statistics showing how many degrees and certifications for those jobs are being earned each year.

The results found truck drivers will account for 43 percent of expected growth in logistics jobs, but those will also be the positions with the fewest workers trained to fill them.

That doesn't surprise Tom Pronk, vice president of recruiting for C.R. England, a Salt Lake City, Utah-based company that employs 7,500 truck drivers who deliver foods from companies such as Hershey, Nestle, ConAgra and Coca-Cola to retailers.

"We have an endless need basically in the industry," Pronk said. "Everybody I talk to is very thirsty for drivers. My personal opinion is it's only going to get worse before it gets better."

Truck drivers make decent money. The Department of Labor says the median yearly wage for tractor-trailer drivers is $37,770, with some drivers earning more than $57,000. Handte and Pronk both said some drivers can clear $100,000 a year.

Both men said older drivers are feeling pressured to retire by federal safety regulations enacted in 2010 that keep a closer watch on drivers' work hours, drug testing, and any tickets and traffic citations they get on the job. And the job can be hard to sell to younger workers who don't think it's worth the money to spend days and weeks on the road away from their families.

"For our new generation who's coming into the industry, the job is not as romantic to them as it was to their predecessors," Pronk said. "It's a tough job to be an on-the-road trucker."

Truck drivers don't need college degrees but they do need to earn a commercial driver's license. That can take a month or longer of taking classes that cost $3,000 or more.

Trucking companies are trying different approaches to lure young drivers into their rigs. Some offer higher wages ? a few extra cents per mile ? or work with their drivers to carve our shorter routes designed to get them home sooner. C.R. England, which operates five driver training schools in the U.S., is refunding tuition to graduates after they work six months for the company.

David Sheehy of Greely, Colo., just graduated from the company's school in Salt Lake City. He'll be paired with an experienced driver for the next month, perhaps longer, before hitting the road on his own.

Sheehy, 32, said economic hardships in his hometown pushed him toward trucking after years of bouncing between different jobs with little stability. He drove a tow truck, worked for a car rental company and even was an umpire calling little league and high school baseball games. He's single and excited about seeing new parts of the country. And he's eager to earn steady pay.

"It is truly a special breed," Sheehy said. "You're talking about long hours, weeks on the road at a time, time away from family. There are a lot of negative things.

"But they told me a first-year driver can gross $40,000 a year easily," he said. "You're taking about financial security there."?

(AP) ? President Barack Obama will travel to storm-stricken New Jersey on Wednesday to view damage from the massive storm that struck the East Coast and to thank first responders.

The White House says Obama will join New Jersey Gov. Chris Christie in viewing the damage. Christie is a Republican who has been an Obama critic. But on Tuesday he praised Obama's leadership in dealing with the storm disaster.

Obama said Tuesday at Red Cross headquarters that the storm "is not yet over." He said there are still risks of flooding and downed power lines and called the storm "heartbreaking for the nation."

The president offered his thoughts and prayers to those affected and said "America is with you." He said he told government officials coordinating the response that there was "no excuse for inaction."
